1.2. BUYER-CUSTOMER
Name, Surname, Turkish ID Number/Passport Number, Phone, Address, and Email information are included in the RESERVATION FORM, which is an INTEGRAL PART OF THE AGREEMENT.
2. DEFINITIONS
In this Agreement;
- SITE: The website www.valinortravel.com, where various services and content are offered online within the framework determined by the Seller,
- Call Center: The call center number +90 552 475 03 49,
- SELLER: Maydo Tourism and Trade Limited Company,
- BUYER or CUSTOMER: The person(s) purchasing services through the website or the Call Center,
- SUPPLIER or HOTEL: The hotels providing accommodation services sold through the website or the Call Center,
- PRODUCT/SERVICE: Products and services offered and purchasable by the Seller to the CUSTOMER.
3. SUBJECT OF THE AGREEMENT
The subject of this Distance Sales Agreement is the sale of the accommodation service, details of which are included in the RESERVATION FORM, AN INTEGRAL PART OF THE AGREEMENT, (Room Type, guest information, duration of stay, fee information, payment method, etc.), the purchase of the accommodation service by the CUSTOMER, and the procurement of the service by the SELLER/SUPPLIER, as per the provisions of the Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, determining the mutual rights and obligations of the parties.
4. SERVICES AND PAYMENT INFORMATION
The total price of the accommodation service, including taxes, to be purchased or reserved, is provided to the CUSTOMER before completing the purchase and/or reservation process. The CUSTOMER will not be responsible for any additional costs, expenses, commissions, or fees that may be requested by intermediaries such as banks in credit card transactions. When the CUSTOMER approves the service purchase, the service fee (including taxes and other costs) will be charged to the credit card used for payment. The credit card holder does not need to be one of the guests.
5. GENERAL PROVISIONS
The CUSTOMER acknowledges that they have been informed about the essential qualities of the Products and Services subject to this Agreement, the total sales price, including all taxes, the payment method, and the full title, address, and contact information of the SELLER before concluding this Agreement, in an explicit and understandable manner electronically or via the call center, and confirmed this information electronically or via phone or email, and then approved the reservation and the Agreement. All prices and fees mentioned in this Agreement include VAT and all other taxes.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The CUSTOMER accepts that they are informed about the characteristics of the purchased service through the Pre-Information, Pre-Information Form, and/or brochure.
6.2. The parties accept that they will comply with the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, in addition to the terms of this Agreement.
6.3. The CUSTOMER accepts that they are responsible for providing accurate information regarding the participants (name-surname, Turkish ID number, passport number, address, credit card information, etc.) for the accommodation service and informing the other participants about the details of the brochure and Pre-Information Form. The CUSTOMER is responsible for providing this information to other participants, and the brochure is considered given to the participants. The CUSTOMER acknowledges that they are legally responsible for any disputes arising from this matter.
6.4. The CUSTOMER accepts that they are responsible for their baggage and contents and for tracking and controlling their belongings. The SELLER/SUPPLIER and/or their employees are not liable for any lost, stolen, or damaged items, and the CUSTOMER will not make any claims against the SELLER/SUPPLIER and/or their employees for such incidents.
6.5. The CUSTOMER accepts that they will comply with the laws and customs of the accommodation facility and the rules notified by the facility officials regarding the purchased service. If the CUSTOMER endangers the life and property safety/integrity of third parties, they are personally and primarily responsible for all material/moral, legal/criminal damages that may arise, and the SELLER/SUPPLIER will not be obliged to provide the service in such cases. In such cases, the CUSTOMER has no right to claim a refund.
6.6. The CUSTOMER accepts that they are responsible for paying for all extra food and drinks, personal expenses, and any goods and services outside the defined service during their stay.
6.7. In cases where the CUSTOMER is at fault, unexpected and unavoidable behavior by a third party, or force majeure (adverse weather conditions, road obstacles, strikes, terrorism, fog, the possibility of war, unforeseeable technical issues, etc.), if the service cannot be provided despite the SELLER/SUPPLIER/agency/independent service provider taking all necessary care, the CUSTOMER accepts that they have no right to compensation.
6.8. If the credit card used for payment is used unauthorizedly by third parties, not due to the fault of the SELLER, and the bank or financial institution does not pay the service fee to the SELLER, the CUSTOMER is responsible for the disputed service fee and all damages, including the legal interest accruing from the reservation date.
6.9. If the SELLER/SUPPLIER unjustly withdraws from providing the service, the SELLER/SUPPLIER is responsible for the total fee. If the CUSTOMER unjustly withdraws from the service, they agree to pay the total service fee.
6.10. The CUSTOMER is obliged to notify the SELLER in writing of any complaints within 7 (seven) days after the end of the accommodation. Otherwise, the CUSTOMER is deemed to have received the service without any defects.
6.11. If the CUSTOMER does not check in to the reserved hotel, the reservation will not be canceled, and the paid fee will not be refunded.
7. FORCE MAJEURE
The parties acknowledge the occurrence of force majeure events during the term of this Agreement. Examples of force majeure include pandemics, natural disasters, wars and mobilization, government decisions, strikes, lockouts, fires, floods, earthquakes, storms, terrorist events, transportation interruptions, adverse weather conditions, civil war, uprisings, rebellions, explosions, and similar causes. In case of force majeure events, the parties are justified in not fulfilling their obligations under this Agreement. In such cases, the parties cannot claim compensation or receivables due to the non-fulfillment of this Agreement. If the force majeure event lasts more than 30 (thirty) days, this Agreement will automatically terminate.
8. RETURN AND CANCELLATION CONDITIONS
8.1. The CUSTOMER must stay during the specified period to fully benefit from the purchased accommodation service. The CUSTOMER can request cancellation or changes up to 5 days before the specified date and time. Cancellation and change requests must be made in writing, and the service fee will be fully refunded within 14 (fourteen) days from the receipt of the request.
8.2. The CUSTOMER can make free cancellation and change requests until 5 days before the accommodation date. However, for cancellation and change requests made less than 5 days before the accommodation date, 50% of the payment will be refunded. No payment refunds will be made for cancellation and change requests made less than 24 hours before the accommodation date.
8.3. In the presence of force majeure and if documented by the CUSTOMER, the total payment will be refunded. Force majeure includes natural disasters, pandemics, states of war, and similar situations.
9. EVIDENCE AGREEMENT AND COMPETENT COURT
9.1. In the implementation of this Agreement, the records of the SELLER (including records in magnetic media such as computer and voice recordings) constitute evidence.
9.2. In the event of any disputes arising from the implementation of this Agreement, Istanbul Courts and Enforcement Offices are authorized.
10. ENFORCEMENT
The CUSTOMER declares that they have read and understood all the provisions of this Agreement, accepted all the information provided in the pre-information form, and signed this Agreement electronically or in writing with the reservation process.
